How to Determine Your Main Schengen Destination

Under Article 5 of the Schengen Visa Code, applicants are not free to apply at whichever European embassy they choose. Applying at the wrong consulate is a leading reason for immediate application rejection or refusal of intake at the visa center.

The Hierarchy of Consular Competence

Consulates determine jurisdiction using a strict two-tier test:

1. Criterion 1: The Main Purpose of Stay: If a trip has a distinct primary purpose—such as attending a medical procedure or an international trade conference in Germany—Germany is the competent authority, even if you spend additional days vacationing in France afterward.
2. Criterion 2: The Longest Duration of Stay (Number of Nights): For general leisure tourism across multiple member states, the country where you spend the highest number of nights has sole jurisdiction. For example: 4 nights in Spain, 6 nights in Italy, 3 nights in France = You must apply at the Italian Embassy.
3. Criterion 3: Port of First Entry (Tie-Breaker Only): If you spend an exactly equal number of nights in two or more countries (e.g., 5 nights in France and 5 nights in Spain), you must apply at the consulate of the country you enter first.
